Touch REGISTERED USER AGREEMENT

This Registered User Agreement governs the rights and responsibilities concerning the Touch website registration and use.
If you are registering to the Touch website, please take your time to read and understand it since you will be bound by these terms.

1.Electronic notices

By registering to Touch website, you agree to transact and receive all notices electronically with the network .

You cannot become a Touch registered member until you have accepted the Registered User Agreement. By completing the registration process to join the Touch website, you affirmatively agree to accept the terms of this Registered User Agreement and the Touch Privacy Policy. Each time you logon to Touch website, you reaffirm your acceptance of the current Registered User Agreement. However, if you do not wish to be bound by this Registered User Agreement, you may discontinue using the Touch website.
2.Modifications

Touch may change the Terms of Service, in its sole discretion, from time to time. The modified Terms of Service will be effective immediately upon posting, and you reaffirm your acceptance to the new posted Terms of Service by continuously logging to Touch Website. If you do not agree with the modified Terms of Service, your only remedy is to discontinue using the Touch website and cancel your registration.
3.Requirements for Registration

You denote and warrant that you have adequate legal capacity to enter into binding agreements such as this Registered User Agreement. When you register, you will receive a screen name that requires you to enter your name, e-mail address, gender, date of birth, or similar information as is required.
4.Registered User Information

The Touch Privacy Policy explains how Touch collects and uses information. You consent to the Touch website using your registered User Agreement under the terms of Touch Privacy Policy.
By registering with or using Touch website, you consent to the collection and use as well as to the transfer of your personal information to the Touch website.
Affiliate Sites
Your use of websites offered by affiliated providers will be subject to their own terms, codes of conduct or guidelines that govern use of those sites. You agree to abide by such other terms and conditions and operating rules. This Registered User Agreement in no way modifies or preempts the terms and conditions of the affiliated providers' websites. Your violation of the terms and conditions of any affiliated provider's website while using your Touch screen name, or by accessing those sites through the Touch website, shall constitute a breach of this Agreement.
5.Your Responsibility

You are responsible for all activity made by you or anyone you allow to use your Touch account and screen name, including your children, other members of your family or friends. You are responsible for obtaining your own Internet access, including maintaining all telephone, computer hardware, and other equipment needed for access to and use of the Touch website, and all charges related thereto. Any telephone or other communications charges incurred by you to access the Touch website are your responsibility. Since these charges are your responsibility, you should contact your local telephone company or communication provider if you have a question about whether your access carry any long distance charges or other toll charges from your location.
You May Use the Network for Lawful Purposes Only
You may use the Touch's features, offerings and content for lawful purposes only.
You agree to provide the Touch website with accurate, complete and updated registration information, and you agree to keep such information current. You may not (1) select or use a screen name of another person with the intention of impersonating that person, (2) use a screen name of anyone else without authorization, (3) use a screen name in violation of the intellectual property rights of any person, (4) use a screen name that the Touch considers to be offensive or (5) send unsolicited bulk e-mail. You agree to abide by any operating rules posted by the Touch website.
You shall not upload, post or otherwise make available on any community areas such as message boards, chat, web pages and instant messenger any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. You are responsible for determining whether copyright, trademark or other proprietary right protects such material. You shall be solely liable for any damages resulting from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from any uploading, posting or submission.
6.Proprietary Rights

The Touch website contains copyrighted material, trademarks and other proprietary information including text, software, photos, video, graphics, music and sound, and the entire content of the Touch website is copyrighted.
The Touch website owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. Each third party content provider and the affiliated providers own the copyright in content original to them.
You may not modify, publish, transmit, display, participate in the transfer or sale of, create derivative works, or in any way exploit the content of the Touch website or any portion of it. Except as otherwise expressly permitted under copyright law, you may not copy, redistribute, publish, display or commercially exploit any material from the Touch website without the express permission of Touch and the copyright owner.
No portion of the content on the Touch website may be stored in a computer except for personal and non-commercial use.
7.No Endorsement

The Touch website is not responsible for the availability of these external sites nor does it endorse, or is it responsible for the aesthetics, appeal, suitability to taste or subjective quality of informational content, advertising, products or other materials made available on or through such external sites. Under no circumstances shall Touch or any of the affiliated providers be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to you in connection with the use of or reliance on any content, goods or services available on such external site.

8.Disclaimer of Warranty; Limitation of Liability.

9.Indemnification

11.Miscellaneous

The provisions of this Registered User Agreement addressing disclaimers of representations and warranties, indemnity obligations, intellectual property, Subscriptions and governing law shall survive the termination of this Agreement, your Subscriptions and your registration with the Touch website.
This Registered User Agreement and any operating rules for any areas of functionality of the Touch website established by the Touch website constitute the entire agreement between the Touch website and you regarding the subject matter of this Registered User Agreement, and supersede all previous oral agreements.
This Registered User Agreement shall be deemed supplemented by other terms of service or operating rules for any particular content, software, tools, services or functionality, except that in the event of any inconsistency between this Registered User Agreement and any such other terms of use or operating rules, this Registered User Agreement will supersede such other terms of sue or operating rules.
The Terms of Service and Registered User Agreement shall be governed by and construed in accordance with the Lebanese laws.
You expressly agree that the exclusive jurisdiction for any claim or dispute under the Terms of Service and Member Agreement or your use of the Touch website resides in the courts, and you further expressly agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action.
No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
